Terms and conditions
(According to Chapter I, Title 3, Part 3, of Legislative Decree 206/2005 and subsequent amendments and additions)
1. Premise and Effectiveness of the General Conditions
These general terms and conditions of sale (hereinafter "General Conditions") govern the purchase of products and services, made remotely and available via the internet on the website www.caseificiofiordilatte.it (hereinafter the "Site") in compliance with Italian legislation pursuant to Legislative Decree 206/2005 and subsequent amendments and additions (hereinafter "Consumer Code").
The seller of the products and owner of the Site is: Caseificio Sociale Fior di Latte S.C. located at Località Torretta, 225. 40041 Gaggio Montano BO, VAT number 02355090354 Email address: info@caseificiofiordilatte.it (hereinafter "Fiordilatte").
The consumer who accesses the Site to make purchases (hereinafter "Customer") is required to read these General Conditions carefully before sending the order, as they are made available on the Site.
If the person making purchases on the Site requests the issuance of an invoice and/or is not a "consumer or user" as defined in Article 3, paragraph 1, letter a) of the Consumer Code, the withdrawal regulations of Articles 7 and 8 of these General Conditions and, more generally, the provisions that, under the same Consumer Code, apply only to "consumers" will not apply.
Contracts concluded with Fiordilatte through the Site are governed by these General Conditions in compliance with Italian law. The language available for concluding the contract is Italian.
2. Choosing and Ordering Products
The characteristics and the price of the various products for sale on the Site (hereinafter "Product" or "Products") are shown on the page relating to each Product.
To purchase the Products, the Customer must complete and send the order form in electronic format, following the instructions contained on the Site. The Customer must add the Product to the "Cart" and, after reviewing the General Conditions and Privacy Policy and confirming their acceptance, must enter the shipping and billing details, select the desired payment method, and confirm the order.
By submitting the order from the Site, which has the value of a contractual proposal, the Customer acknowledges and declares to have read all the information provided during the purchase procedure and to fully accept these General Conditions and payment terms.
The contract stipulated between Fiordilatte and the Customer must be considered concluded with the acceptance of the order by Fiordilatte. This acceptance is communicated to the Customer through an email confirming the order containing the order number, shipping and billing data, the list of Products ordered with their essential characteristics, and the overall price, including delivery costs. The Customer will check the confirmation email and, if there are any errors in the order, can promptly contact Fiordilatte to communicate any corrections. Once the order is being processed for shipment, no changes will be accepted, without prejudice to the Customer's rights under Article 7 below.
Upon receipt of the order, Fiordilatte will check the availability of the stock to fulfill the order. If one or more Products are not available, Fiordilatte will promptly notify the Customer via email, who will have the option to respond within the next 12 hours to confirm the shipment of any additional available Products or cancel it. If no response is received within this period, the order will be considered confirmed, and the available Products will be shipped. In either case, the amount related to the missing Products will be immediately refunded according to the payment method chosen.
3. Product Information
Information and characteristics related to the Products are available on the Site, along with their respective Product codes.
The visual representation of the Products on the Site, where available, usually corresponds to the photographic image accompanying the product description. It is understood that the image of the Products themselves is for presentation purposes only and may not be perfectly representative but may differ in color and size. In case of a difference between the image and the written product sheet, the description in the product sheet will prevail.
4. Prices and Shipping
Product prices include all taxes and fees. All prices are expressed in Euros.
Any customs duties are borne by the customer.
Shipping costs are indicated on the checkout page and are calculated precisely after entering the shipping address. Any shipping promotions are indicated in the cart.
5. Payment Methods
The Customer can pay for the Products and related delivery costs by credit card, bank transfer, prepaid cards, or cash on delivery.

To ensure maximum security, the Customer will make the payment transaction directly on the bank's secure server.
The Site does not store the Customer's credit card number, but thanks to the protected communication system of the reference credit institution, from the second purchase, the Customer who wishes – by selecting the appropriate option – can proceed with the purchase without re-entering their data. The reference credit institution uses the SSL protocol to encrypt the data transmitted between its server and the Customer's browser.
Bank Transfer:
The Customer must make the transfer within 3 days from the date of the order for product orders. If payment is not made within 3 days, the order will be canceled, and the goods will be made available again for purchase by other Customers. The Customer who has not made the transfer may be contacted by Customer Service to clarify whether the cause of the non-credit is due to the Customer's intention not to confirm the purchase or other reasons.

Reason: the Customer must indicate the order date and number in the reason for the transfer, which can be found in the confirmation email (e.g., "Order no. 8922).
Fiordilatte Gift Card - Coupon:
The Customer must enter the Coupon Code in the Cart. The amount will be automatically updated.
6. Order Invoicing
If the purchase is made by a company or a professional, it will be possible to request the issuance of an invoice by entering the billing details, including tax code, VAT number, and recipient code or PEC in the case of an electronic invoice. In this case, the invoice will be sent via email to the address provided. The invoice requester is responsible for correctly entering the billing details.
7. Shipping, Transport, and Delivery
Fiordilatte commits to shipping the goods within 24 hours of order confirmation for all orders placed from Monday to Thursday by 10 am. Orders placed after 10 am on Thursday and on Friday will be processed on Monday. Perishable products are not shipped on Fridays to avoid remaining in courier warehouses. Shipments received after 10 am on Thursday will be postponed to the following Monday.
To ensure the preservation of the products, they are vacuum-packed and appropriately packaged. Perishable products, such as fresh cheeses, are not shipped. During certain periods of the year, such as summer, shipments may be temporarily suspended to avoid product spoilage.
Product shipments are made via express courier SDA / GLS / DHL / BARTOLINI.

REST OF EUROPE: 4 / 6 working days
Upon shipment, you will receive an email with instructions to track the delivery online.
For islands and remote locations, delivery times may be longer than indicated.
The customer is required to promptly provide Fiordilatte, the courier, customs, or any other institution involved in the logistics of the order with all the necessary information or personal data for the delivery of the order.
Non-delivery
In case of refusal of the goods without reason by the customer or non-delivery for other reasons (incorrect address and/or phone number of the recipient, repeated absence of the recipient), Fiordilatte will retain the entire amount of the order.

Products purchased on the Site will be delivered to the address indicated by the Customer during the purchase procedure in the "Personal Data" field.
All purchases will be delivered by express courier (hereinafter "Courier") from Monday to Friday, excluding public holidays and national holidays. Fiordilatte is not responsible for unforeseeable delays or delays not attributable to it.
Once the Products are shipped, the Customer will receive a confirmation email containing a link to track the shipment.
In any case, except in cases of force majeure or fortuitous events, the Products ordered will be delivered within 7 (seven) working days from the day following the day Fiordilatte confirmed the order to the Customer via an order confirmation email.
8. Right of Withdrawal
The Customer has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without penalty, subject to the cases of exclusion provided for in point IV below. To exercise this right, the Customer must send a communication to Fiordilatte within 14 days from the date of receipt of the Products. If the Customer intends to exercise the withdrawal before receiving the Products, the communication of withdrawal may be sent at any time before their receipt.

Once the communication is received, Fiordilatte will open a return management procedure and communicate to the Customer the instructions on how to return the Products, which will be done through a courier indicated by Fiordilatte itself.
The right of withdrawal is governed by the following conditions:
The right applies to the purchased Product in its entirety; therefore, if the Product is composed of multiple components or parts, it is not possible to exercise the withdrawal only on part of the purchased Product.
In case of exercising the right of withdrawal, Fiordilatte will refund the Customer the entire amount of the returned goods within 14 days from the date of receipt of the withdrawal communication, without prejudice to Fiordilatte's right to suspend the refund payment until the actual receipt of the goods. The refund will be made using the same payment method used by the Customer unless the Customer has expressly requested a different method. In case of bank transfer or cash on delivery payment, the Customer must provide the bank details on which to obtain the refund (account holder, name and address of the Bank, and IBAN).
Products must be returned in the same box in which they were received.
In addition to the cases indicated in the Premise (non-consumer customer and/or requesting an invoice), the right of withdrawal is excluded in the following cases, pursuant to Article 59 of Legislative Decree 21/2014:
Order of Products made to measure or clearly personalized;
Order of sealed/ vacuum-sealed FOOD Products that are not suitable to be returned for hygienic reasons or related to health protection and that have been opened after delivery.
Therefore, for hygienic reasons and customer protection, the right of withdrawal is applicable only to Products purchased on the Site that can be returned to Fiordilatte and put back on the market without endangering consumers' health.
9. Warranty and Conformity Defects
In case of conformity defects of Products sold by Fiordilatte, the Customer must immediately contact Fiordilatte via email at info@caseificiofiordilatte.it or customer service at Tel.
The legal guarantees provided for in Articles 129, 130, and 132 of the Consumer Code apply to the sale of Products. The Customer has the right, at their choice and provided that the type of Product allows it, to restore the conformity of the Product, without charge, by repair or replacement, or to an appropriate price reduction or contract termination. The Customer loses these rights if they do not report the conformity defect to Fiordilatte within two months from the date they discovered the defect, unless it is a Product that by its nature is perishable or subject to expiration in a shorter period, in which case the defect must be reported within such shorter period.
10. Errors and Limitations of Liability
Product information provided through the Site is constantly updated. However, it is not possible to guarantee the complete absence of errors, of which Fiordilatte cannot be held responsible, except in cases of willful misconduct or gross negligence.
Fiordilatte reserves the right to correct errors, inaccuracies, or omissions even after an order has been sent, or to modify or update the information at any time without prior notice, without prejudice to the Customer's rights under these General Conditions and the Consumer Code.
Except in cases of willful misconduct or gross negligence, any Customer's right to compensation for damages or recognition of an indemnity is excluded, as well as any contractual or non-contractual liability for direct or indirect damages to persons and/or property, caused by the non-acceptance or partial processing of an order.
11. Complaints
Any complaint must be forwarded to Fiordilatte using the appropriate contact form accessible directly on the Site through the "Contacts" tab, or by sending an email to info@caseificiofiordilatte.it
Fiordilatte commits to respond to all requests received within a maximum of 7 working days.
12. Online Dispute Resolution for Consumers (ADR and ODR)
ADR
According to Article 49, paragraph 1, letter V of Legislative Decree 6 September 2005 no. 206 (Consumer Code), the customer can use the Joint Conciliation procedure. The Procedure can be initiated if the consumer, after submitting a complaint to the company, within 45 days, has not received a response or has received a response not deemed satisfactory by him.

ODR
Pursuant to Article 14 of Regulation 524/2013, users are informed that in case of a dispute, they can file a complaint through the ODR platform of the European Union, which can be reached at the following link http://ec.europa.eu/consumers/odr/. The ODR platform constitutes an access point for users who wish to resolve disputes arising from online sales or service contracts extrajudicially.
13. Applicable Law and Competent Court
The sales contract between the Customer and Fiordilatte is concluded in Italy and governed by Italian law. For the resolution of disputes relating to the interpretation, execution, or termination of these General Conditions or individual purchase orders, if the Customer is a consumer under the Consumer Code, the court of the place of residence or domicile of the Customer, if located in the Italian territory, will have exclusive jurisdiction; in all other cases, the exclusive jurisdiction is that of the Court of Reggio Emilia, excluding any other competent court.
Pursuant to Article 1341 of the Civil Code, the Customer declares to have read and specifically accept the following articles of these General Conditions: 6 (liability for delivery delays), 10 (right to correct errors - exclusions of liability).
